Terms and Conditions of Supply

These Terms and Conditions of Supply apply to all purchases made through www.rachaeldoesdesign.com (the “site”). By purchasing services or digital products from us, you agree to these terms.

1. Services and Products Offered
​
We provide:

Brand strategy and design packages.

Website design packages (Wix and Shopify).

“Designer for a Day” services.
-
Paid strategy sessions and free discovery calls.
-
Digital downloads for personal use.

2. Ordering Process
​

Branding and Website Packages / Designer for a Day: Complete our contact form to book a free discovery call. Following this, we provide a bespoke proposal and invoice, with payment taken via bank transfer or GoCardless.

Strategy Sessions: Book directly via our online calendar with payment taken through the platform’s secure checkout.

Digital Downloads: Add to cart and checkout online. Downloads are delivered instantly after payment.

3. Pricing and Payment Terms

Branding and Website Packages:

50% deposit upfront.
-
Remaining 50% due upon project completion.
-
Monthly payment plans may be agreed upon in writing.

Designer for a Day:
-
Full payment required upfront via bank transfer or GoCardless.

Strategy Sessions:
-
Payment required upfront during booking.
-

Digital Downloads:
-
Payment required upfront during checkout.
-

Late Payments:
-
Payments overdue by more than 7 days will incur a 20% disruption fee.

4. Delivery of Services and Products

Timelines for Services: Start and end dates will be specified in the contract. Timely client feedback is essential to meet these deadlines. Delays due to the client may result in additional fees.

Digital Downloads: Downloads are for personal use only and may not be shared, copied, or resold.

5. Refunds, Cancellations, and Returns

Branding Packages, Website Packages, and Designer for a Day:

The deposit (30% of the total project fee) is non-refundable.

Refunds for completed stages of work will not be provided.

Strategy Sessions:

Cancellations are permitted up to 24 hours before the session. Refunds will not be provided for missed sessions.

Digital Downloads:
-
Refunds are not available once a download has begun, as per UK law.

6. Intellectual Property Rights

Branding and Website Projects: Ownership of final deliverables transfers to the client only upon full payment. Until payment is complete, all materials remain the property of Rachael Does Design.

Digital Downloads: Downloads are licensed for personal use only. Redistribution, resale, or alteration is prohibited.
7. Client Responsibilities

Provide timely feedback and respond to communications within the bespoke project contract written timeline.

Adhere to agreed timelines to avoid delays or disruption fees.
-
Notify us promptly if the project needs to be paused (maximum pause duration: 3 months).

8. Limitation of Liability
​
We are not liable for:

Any business loss, such as lost profits or revenue.

Delays caused by the client or external factors beyond our control.
-
Dissatisfaction with subjective aspects of design work.
-
Issues arising from third-party services (e.g., printing errors or hosting platform downtime).

Our total liability is limited to the value of the services provided, except in cases of death or personal injury caused by our negligence, or fraud.

9. Governing Law
​
These terms, their subject matter, and their formation are governed by English law. We and you agree to submit to the exclusive jurisdiction of the courts of England and Wales. However, if you are a resident of Scotland or Northern Ireland, you may bring proceedings in those countries.
